1. Introduction and Acceptance

Welcome to CDL Answers, a mobile application designed to help users prepare for Commercial Driver's License (CDL) examinations. By downloading, installing, or using our application, you agree to be bound by these Terms of Service ("Terms"). CDL Answers is operated by Offhand Labs and is not affiliated with, endorsed by, or operated by any government agency, state department of motor vehicles, or official testing authority.

2. Eligibility and User Requirements

You must be at least 18 years of age to use CDL Answers. By using our service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. You are responsible for ensuring you meet all legal requirements for obtaining a CDL in your jurisdiction, including but not limited to medical certifications, background checks, and residency requirements.

3. Service Description

CDL Answers provides practice questions, study materials, and educational content to help users prepare for CDL examinations. Our service includes:

  • Practice tests for CDL general knowledge and endorsements
  • Explanations for test questions
  • Progress tracking and performance analytics
  • State-specific study materials

Our service requires an active internet connection to function. Content and features may vary by state and are subject to change without notice.

4. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use CDL Answers for personal, non-commercial purposes. This license does not permit you to:

  • Reproduce, distribute, or share practice questions or content
  • Use the application for commercial driving school purposes without written authorization
  • Reverse engineer, decompile, or attempt to extract source code
  • Create derivative works or copy any part of the service
  • Use automated tools to access or scrape content
  • Circumvent security measures or access restrictions

5. Subscription and Payment Terms

CDL Answers operates on a subscription model with a 3-day free trial period. Subscription fees are charged through your App Store or Google Play account. By subscribing, you authorize recurring charges unless you cancel before the trial period ends. Refunds are governed by the respective app store's policies.

6. User Conduct

You agree to use CDL Answers in accordance with all applicable laws and regulations. Prohibited conduct includes:

  • Sharing account credentials with others
  • Using the service to cheat on actual CDL examinations
  • Attempting to circumvent payment systems
  • Harassing or impersonating others
  • Uploading malicious code or attempting to disrupt the service

7. Disclaimers and Limitations

NO GUARANTEE OF SUCCESS: CDL Answers does not guarantee that you will pass any CDL examination. Test success depends on numerous factors beyond our control, including your study habits, test-taking ability, and individual state requirements.

SERVICE PROVIDED "AS IS": Our service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely accurate.

CONTENT ACCURACY: While we strive to provide accurate and up-to-date information, CDL requirements and test content may vary by state and change over time. We are not responsible for discrepancies between our materials and actual test content.

8. Limitation of Liability

To the maximum extent permitted by law, Offhand Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or failure to pass CDL examinations. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

9. Intellectual Property

All content, including questions, explanations, graphics, and software, is the property of Offhand Labs or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without written permission.

10. Privacy

11. Termination

We may terminate or suspend your access to CDL Answers at any time, with or without notice, for violation of these Terms or any other reason. Upon termination, your right to use the service ceases immediately, and you must delete the application from your device.

12. Dispute Resolution

These Terms shall be governed by the laws of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of CDL Answers shall be resolved through binding arbitration, except for claims that may be brought in small claims court. You waive your right to participate in class action lawsuits or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the application or by email. Continued use of CDL Answers after changes become effective constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects our intent.
